Online Gambling License in Kansas

The Kansas Racing and Gaming Commission (KRGC) is the regulatory body of Kansas that oversees and regulates all legal gambling in the state. This includes casino gaming and parimutuel wagering (such as horse and greyhound racing). The Commission has 5 members appointed by the governor for a term of 4 years. They meet every 3 weeks and must be residents of Kansas for more than 5 years before their appointment.

The Commission’s primary mission is to ensure the integrity of gambling operations and protect the public’s interests. In an attempt to ensure customer protection, safety and integrity in gambling operations, the KRGC creates guidelines and measures for player protection. It regularly researches gaming market changes and oversees the day-to-day operations of licensees. The Commission enforces all state laws and investigates complaints and violations through random audits and compliance checks. Its main role, however, is licensing and ensuring that licensees meet legal requirements to operate in the state.

For players’ security and to ensure safe gambling, the KRGC offers resources, such as the Kansas Voluntary Exclusion Program and works closely with the Kansas Problem Gambling Alliance to help affected individuals.

The KRGC collaborates regularly with other agencies such as the Department of Revenue (oversees gambling organized by non-profit organizations), the Lottery Commission (oversees lottery games), and the State Gaming Agency (oversees Tribal gaming). It is important to note that while KSGA works as its own agency and enforces the Tribal-State Compacts and the Tribal Gaming Oversight Act, it must still comply with the Kansas Gambling laws.

Types of Gambling Regulated by the KRGC

Sports Wagering

Sports betting in Kansas is regulated, and a legal framework was established in 2022, in Articles 112-201,202, and 203 of the Kansas Racing and Gaming Commissions’ regulation. Based on this framework, the Kansas Lottery and the KRGC regulate and oversee sports betting in the state.

The Kansas Lottery manages and controls sports betting operations, which must work under the Kansas Lottery. However, the law allows partnerships with commercial casinos to provide in-person and online betting. The role of the KRGC is more complimentary – it regulates operational integrity and offers licensing and monitoring to maintain fair play. The Commission also ensures that all sportsbook operators comply with legal frameworks.

The four state-owned retail casinos are authorized by the KRGC, and they are allowed to make business partnerships with other online sports betting platforms, provided they adhere to the legal framework. Online sports betting operations are possible thanks to this. All authorized state casinos can partner with up to 3 online sportsbook platforms to provide these services.

The tax rate from sports betting revenue is set at 10%, and it is calculated after payouts to winners have been issued. The tax revenue is allocated to responsible gambling programs, and a big part of it goes to the “Attracting Professional Sports to Kansas Fund”.

Players must be over 21 years old to participate in sports betting and be physically located within state borders. They are allowed to place a list of predetermined sports bets on professional sports leagues (NFL, MBA, etc) and college sports. The list of permitted bets includes moneyline, parlays, point spreads, prop bets, and live betting, amongst others.

Pari Mutuel Racetracks

Parimutuel Racetracks are fully regulated by the KRGC, despite no parimutuel race tracks operating in Kansas at the moment. The KRGC has the full authority to license racetracks after confirming they meet all legal requirements.

To meet these requirements, the tracks must apply for a license and go through a background check that involves financial stability and operational integrity checks. The KRGC also monitors and inspects licensed racetracks and betting activities while focusing on animal welfare. Veterinarians and stewards must be employed to ensure the latter.

Tax revenue from these activities supports responsible gambling programs. A portion also funds the Kansas Horse Breeding Development Fund. The legal framework for parimutuel betting includes various occupational and concessionaire licenses. It outlines rules for racing, animal health standards, security, safety, and simulcast licenses.

State-Owned Casinos

The Kansas Racing and Gaming enforces 13 articles of regulations on the state-owned casinos. The regulations cover licensing, security, audits, and responsible gambling, among others. In Articles 100-103, the KRGC defines the different licenses and certifications needed for each of the roles. Further on, in Articles 106, 107, and 110, the minimum standards for each gambling aspect are being regulated.

Operators must monitor and conduct surveillance for all operations. They have specific requirements for maintaining surveillance records at all locations. Additionally, the law outlines the KRGC’s responsibilities for electronic gaming machine standards. This includes testing and software installation for live gaming floors, automated jackpot machines, and bonus systems.

Further on, the KRGC is in charge of overseeing whether practices for responsible gambling and involuntary exclusion are in place with the purpose of protecting players. In Article 113, the law presents the different sanctions and tools available to the Commission to enforce the rules.

Regulatory Framework of the KRGC

The main legal acts outlining the responsibilities and jurisdiction of the KRGC are the Kansas Racing Act and the Kansas Expanded Lottery Act.

The Kansas Racing Act establishes the legal framework for greyhound and horse racing and defines the duties of the KRGC for parimutuel betting. It also gives the Commission the authority to license racetrack operators and oversee their activities.

The Kansas Expanding Lottery Act established casino gaming in Kansas in 2007, and it regulates the casinos and their licensing. The complementary role of the KRGC is to enforce compliance of the operators and issue licenses while supporting the Lottery Department as outlined in sections 74-8701 to 74-9731.
