What Is the Virginia Lottery?

This is an independent agency that oversees most legal gambling in Virginia, including land-based casinos, the state lottery, and online sports betting. Horse racing and fantasy sports are regulated separately by the Virginia Racing Commission (VRC) and the Virginia Department of Agriculture and Consumer Services (VDACS).

Founded in 1987 to help fund public education during budget constraints, the Virginia Lottery has since contributed over $13 billion, mostly supporting K-12 schools. Currently, it generates $2.3 million daily for the K-12 education system.

A five-member board, appointed by the Governor, manages the Virginia Lottery’s policies, permit issuance, and consumer protection programs.

Through regular audits and integrity checks, they ensure fair and transparent operations across all casino, lottery, and sports betting activities.

Types of Gambling Regulated by the Virginia Lottery

The Department regulates most of the gambling activities in Virginia, providing their honest, efficient, and economical operation. It oversees the operation and administration of the state lottery, land-based casinos, and sports betting.

Lottery Games

The Virginia Lottery administers the Virginia State Lottery and supervises the available lottery types, ticket prices and distribution, prize sizes, etc. The agency offers a variety of games to cater to different preferences. These include:

• Scratch-Off Tickets: Instant win games offering the chance to win prizes instantly by scratching off a ticket’s surface.
• Draw Games: Traditional multi-state games such as Powerball and Mega Millions, as well as Virginia’s own lottery games like Pick 3 and Pick 4, where players select numbers and wait for the kind draw.
• Print n’ Play games: Combination of the two where the tickets are printed at the terminal, and winners are revealed by scratching. They include Bingo, Blackjack, and Crossword.
• Online Lottery: In recent years, the Virginia Lottery has embraced new technology and allowed players to purchase tickets and participate in games online.

The variety of offerings has not only made the lottery more accessible but has also increased participation rates among Virginians, particularly since online casinos are still illegal in the country.

Regulation of Casinos

The 2020 legalization of casinos in Virginia marked a turning point in the state’s gambling history. Virginia passed legislation allowing for the establishment of casinos in five cities of the Commonwealth.

The Virginia Lottery regulates these casinos, ensuring compliance with state laws and monitoring their operations. Its regulatory framework includes licensing operators, monitoring financial transactions, and ensuring that gaming practices are conducted ethically.

There are three active casinos in the state:

1. Bristol Casino: Virginia’s first state-licensed casino.

Sports Betting

When Virginia legalized sports betting in January 2021, the Virginia Lottery became the official regulatory agency. It oversees both in-person and online sports betting by licensing operators and ensuring they follow state regulations.

Virginia now has 16 legal sportsbooks, with more licenses expected to be issued in the future. Sporttrade is the latest operator to receive a betting license.

The introduction of sports betting has opened new revenue streams for the state and further diversified the gambling landscape in the Commonwealth. The Virginia Lottery enforces strict rules to keep sports betting fair and honest. This includes watching betting patterns closely to prevent any unfair practices.

The Virginia Lottery’s Regulatory Framework

The Virginia Lottery has served as the state’s primary regulatory authority for casino gambling and sports betting since April 2020, issuing licenses to one casino in the state’s five cities and up to 12 online sportsbooks. Casino licenses require a minimum of $300 million in capital investment. They are valid for a 10-year period and, according to 11VAC5-90-70(J)(4), can be renewed every five years.

All proceeds from legal gambling are subject to a graduated tax that grows with the revenue:

• 18% for the first $200m;
• 23% for revenues between $200m and $400m;
• 30% for revenues over $400 million.

The tax revenues are fed into the Gaming Proceeds Fund and go to supporting public school projects. Fiscal 2024 was a record year, bringing in profits of $934 million.

The Virginia Lottery directs 0.8% of the fund to the Problem Gambling Treatment and Support Fund to strengthen self-exclusion programs. It also enforces strict rules for licensed operators, banning alcohol on-site and requiring the Department’s approval for all advertising messages and promotions before they go live.
